Detailed Program Learning Objective Information
In this program, the goal is to develop the competence and discipline to effectively:
- Identify alternatives to Guardianship
- Identify the role and limitations of a guardian of the person and estate
- Explain the statutory distinction and functional differences between certified and non-professional guardians.
- Describe the legal process and various roles in the appointment and conduct of a Guardian: petition, review, appointment procedures, court orders, and more
- Analyze case studies and debate appropriate actions in collaboration with three fictitious incapacitated persons (based on real-world characters and events) and the merits of various approaches. The three cases will involve increasing layers of complexity throughout the program.
- Assess one's own appropriateness as a proposed Guardian in specific cases
- Gather and distill necessary information and identify core issues affecting a specific incapacitated person so you can:
- Synthesize the information and write a plan and reports
- Communicate appropriately with an incapacitated person (IP), the court, family members and other interested parties
- Engage in constructive problem solving when challenged by changing circumstances with an incapacitated person
- Effectively navigate the social and health service system on behalf of their client(s).
- Act appropriately within the role and responsibilities of a fiduciary
- Assure that the equality and dignity of incapacitated persons are respected; and, to the highest degree possible, to respect and help them exercise their rights to self-determination
- Work with the legal and regulatory frameworks in Washington State to protect the person and estate of incapacitated persons
- Employ a variety of ethical frameworks and decision-making modelswhen faced with ambiguous situations and take action based on substituted judgment and/or best interest standards.
- follow the steps required to become a Washington CPG-Certified Professional Guardian
- begin, operate and sustain an ethical, commercially-viable, professional guardianship business as an entrepreneur
